Localism Bill — Clause 5 — Power for Secretary of State to Repeal Laws Conflicting with General Power of Competence for Local Government — 17 May 2011 at 19:30

Stewart Jackson MP, Peterborough voted t to limit the power of the Secretary of State to repeal laws considered to detract from the general power of competence for local authorities.

The majority of MPs voted not to limit the powers of the Secretary of State to repeal laws which the Secretary of State thinks prevent or restrict local authorities from exercising their general power of competence.

MPs were considering the Localism Bill[1] when they voted on the amendment which was the subject of this vote.

The amendment rejected in this vote would have prevented the Secretary of State from being able to amend, repeal, revoke or disapply any part of the Localism Bill and a list of other laws including the Freedom of Information Act, Equalities Acts, Housing Acts and more. The full list of rejected exclusions from the Secretary of State's powers is contained within the text of the amendment[2][3].

The amendment would have had an effect on Clause 5 of the Localism Bill as it stood at the time of the vote[4].
