The majority of MPs approved proposed criteria for determining if legal aid is to be awarded in particular circumstances.
The motion approved in this vote was:
- That the draft Civil Legal Aid (Merits Criteria) Regulations 2012, which were laid before this House on 29 October, be approved.
The criteria include a "Reasonable private paying individual test" for legal aid funding that is if:
- a reasonable private paying individual would be prepared to start or continue the proceedings having regard to the prospects of success and all the other circumstances of the case.
