The clause in question was New Clause 42[2] titled Firearms’ licensing which introduced a presumption that a firearms license ought be refused where substantiated evidence of violent conduct, domestic violence, mental illness or drug or alcohol abuse is found in background checks following a licence application. The clause also sought to ensure the costs of the licencing scheme were covered by application fees.
