The amendment rejected in this vote was:
Amendment: 6, page 157, line 33, at end insert—
- ‘(4) An order under section 4A, whether modified or not by the Secretary of State, may only be made with either: consent of all of the relevant local authorities and relevant fire and rescue authority, or a majority vote by local people through referendum.”
The amendment was accompanied by the following explanatory note:
- This amendment would ensure that a PCC can only take over a Fire and Rescue Service with the approval of local people or their local representatives.
The amendment would have added the above subclause to paragraph 5 of Schedule 1 of the Bill. The order under section 4A referred is an order by The Secretary of State under the provision titled: Power to provide for police and crime commissioner to be fire and rescue authority. Section 4A is a proposed new section for the Fire and Rescue Services Act 2004 contained within Schedule 1 of the Policing and Crime Bill.
