Guy Opperman MP, Hexham voted with the majority (Teller for the Noes).

The majority of MPs voted against requiring the consent of the relevant local councils and the fire authority, or the majority of people taking part in a referendum, before a Police and Crime Commissioner is given responsibility for a Fire and Rescue Service.

MPs were considering the Policing and Crime Bill[1].

The amendment rejected in this vote was:

Amendment: 6, page 157, line 33, at end insert—

  • ‘(4) An order under section 4A, whether modified or not by the Secretary of State, may only be made with either: consent of all of the relevant local authorities and relevant fire and rescue authority, or a majority vote by local people through referendum.”

The amendment was accompanied by the following explanatory note:

  • This amendment would ensure that a PCC can only take over a Fire and Rescue Service with the approval of local people or their local representatives.

The amendment would have added the above subclause to paragraph 5 of Schedule 1 of the Bill. The order under section 4A referred is an order by The Secretary of State under the provision titled: Power to provide for police and crime commissioner to be fire and rescue authority. Section 4A is a proposed new section for the Fire and Rescue Services Act 2004 contained within Schedule 1 of the Policing and Crime Bill.
