The rejected amendment was accompanied by the following explanatory statement:
- This amendment removes the 350 megawatts limit on the Welsh Government’s legislative competence in the field of energy.
The amendment would have impacted Clause 36 of the Wales Bill[2]. The clause sought to amend Section 15 of the Planning Act 2008 which defined a generating station with a capacity more than 50 megawatts as "significant national infrastructure", in relation to which planning decisions are made by the UK central Government. Clause 36 of the Wales Bill sought to increase this to 350 megawatts.
The amendment rejected in this vote sought to remove any threshold, excluding all proposals relating to non-wind generating stations in Wales from the UK National Infrastructure Planning arrangements.
