The majority of MPs voted to base legal aid payments for criminal defence work on the category of offence involved; rather than on factors such as the number of pages of prosecution evidence.
The motion rejected by the majority of MPs taking part in this vote was:
- That the Criminal Legal Aid (Remuneration) (Amendment) Regulations 2018 (S.I., 2018, No. 220), dated 20 February 2018, a copy of which was laid before this House on 23 February, be revoked.
The regulations reformed the way legal aid is paid in criminal cases, moving from basing payments on factors including the number of pages of prosecution evidence, and number of witnesses, to instead basing them on the categorisation of the offence that the defendant is charged with.
