Mental Health Bill [HL] — requirement for incompetance of patient. — 10 Jan 2007 at 17:16
The mental health bill is largely being used to amend the 1983 Mental Health Act. This is therefore an amendment to amend that Act.
This amendments relates to detention under the Act under sections two and three - commonly known as sectioning. There are currently two conditions to being sectioned firstly you have to have mental health problem which warrants admission to hospital and secondly and secondly there should be an issue of safety to the patient or others.
This amendment adds a third condition that "(aa) because of his mental disorder, his ability to make decisions about the provision of medical treatment is significantly impaired" to both of these sections
