Immigration Bill — Clause 11 — Restrict Right to Appeal Immigration Decisions to the First-tier Tribunal — 30 Jan 2014 at 16:00

The majority of MPs voted to significantly restrict the circumstances in which an immigration decision may be appealed to the relevant Tribunal.

MPs were considering the Immigration Bill^[1]. The amendment rejected in this vote was:

• Amendment 1, page 8, line 19, leave out leave clause 11.

Clause 11 which remained in the Bill following this vote:

• Significantly restricted the circumstances in which an immigration decision may be appealed to the relevant Tribunal. The clause replaced section 82 in Part 5 of the Nationality, Immigration and Asylum Act 2002 which provided for a right of appeal to a tribunal in relation to a broad list of immigration decisions with a much more restricted set of circumstances.
• Introduced an "administrative review" procedure for use when there is no right of appeal.
• Provided a right of appeal for The Secretary of State's refusal of a "protection claim"; where the refusal is claimed to breach the Refugee Convention or a grant of humanitarian protection.
• Prevented appellants from raising new grounds before the Tribunal before the Secretary of State has had a chance to consider them.
