Draft Important Public Services (Education) Regulations 2017 — 40% Strike Ballot Threshold for State School Teachers — 8 Feb 2017 at 20:51

The majority of MPs voted for the support of 40% of those entitled to vote in a ballot for industrial action by state school teachers to be required for such action to be lawful.

The motion supported by the majority of MPs in this vote was:

• That the draft Important Public Services (Education) Regulations 2017, which were laid before this House on 5 December 2016, be approved.

The regulations define teachers, including head teachers, at:

• a school other than a fee-paying school;
• a 16-19 Academy; or
• a further education institution other than one whose services to persons of compulsory school age are not publicly funded,

as providers of "important public services" in relation to which there is a requirement for the support of 40% of those entitled to vote in a ballot for industrial action for such action to be lawful.

The provision allowing regulations defining "important public services" which are subject to the 40% threshold was introduced by section 3 of the Trade Union Act 2016 which amends section 226 of the Trade Union and Labour Relations (Consolidation) Act 1992.
