Health and Care Bill — Clause 39 — Reconfiguration of Services: Intervention Powers — 23 Nov 2021 at 18:00

The majority of MPs voted to allow the Secretary of State to intervene in decisions by NHS England or Integrated Care Boards which change the range of NHS services available to individuals, or the manner in which they are delivered.

MPs were considering the Health and Care Bill.[1][2][3]

The amendment rejected in this vote was:

  • Amendment 70, page 48, line 34, leave out clause 39.

Clause 39[2] was titled: Reconfiguration of services: intervention powers provided for a new Schedule to the National Health Service Act 2006 titled: Intervention Powers in Relation to the Reconfiguration of NHS Services", the Schedule required the Secretary of State to be notified of proposals, or requirements, to change the range of NHS services available to individuals, or the manner in which they are delivered, and empowered them to intervene in any related decisions.
