Crime and Courts Bill — New Clause 3 — Modification of NCA functions — 13 Mar 2013 at 15:45

The majority of MPs voted to allow the Home Secretary to confer counter-terrorism functions on the National Crime Agency and remove or modify those functions.

MPs were considering the Crime and Courts Bill[1]. The new clause supported by the majority of MPs in this vote was New Clause 3 titled Modification of NCA functions. The proposed new clause provided a power for the Home Secretary to confer counter-terrorism functions on the National Crime Agency and remove or modify those functions.

The clause included the following caveat relating to Northern Ireland:

  • If an order under this section confers an NCA counter-terrorism function, an NCA officer may only carry out activities in Northern Ireland for the purpose of the discharge of the function if the NCA officer does so with the agreement of the Chief Constable of the Police Service of Northern Ireland.
