The majority of MPs voted in favour of making it a criminal offence for a person subject to immigration control to work if they have not been granted leave to enter or remain, have overstayed that leave, or are in breach of a condition on that leave that prohibits work.

The amendment rejected in this vote was:
- Amendment 19, page 5, line 2, leave out Clause 8.
Clause 8 of the Bill[2] provided for an offence of illegal working. The offence was defined as:
- (1) A person who is subject to immigration control commits an offence if
the person works at a time when—
- (a) the person has not been granted leave to enter or remain in the
United Kingdom, or
- (b)the person’s leave to enter or remain in the United Kingdom—
- (i) is invalid,
- (ii) has ceased to have effect (whether by reason of curtailment, revocation, cancellation, passage of time or otherwise), or
- (iii) is subject to a condition preventing the person from doing work of that kind.
An explanatory note accompanying the rejected amendment stated:
- To omit the clause on the new illegal working offence and maintain the status quo.
