Mental Capacity (Amendment) Bill — Second Reading — 18 Dec 2018 at 18:53

The majority of MPs voted for a new scheme of authorisations and safeguards intended to protect those subject to the deprivation of liberty for the purposes of healthcare.

MPs were considering the Mental Capacity (Amendment) Bill[1][2].

The Bill sought to simplify the system for authorising deprivation of liberty; to ensure consultation with carers, families and others; and to introduce "Approved Mental Capacity Professionals" to review an authorisation if the cared-for person objects to it. The Bill also extended the period for the renewal of authorisations to three years in certain circumstances.

The motion supported by the majority of MPs in this vote was:

  • That the Bill be now read a Second time.

The Bill applied to England and Wales.

The passing of this motion enabled the bill to continue on the path to becoming law.
