Mental Health Bill [HL] — Exclusions from the Act — 19 Feb 2007 at 17:37
The mental health bill is largely being used to amend the 1983 Mental Health Act. This is therefore an amendment to a bill to amend that Act.
As it stood before this amendment the Bill would remove the ban on forced detention ("sectioning") for "promiscuity or other immoral conduct, sexual deviancy"
This amendment added exclusions to dention on the grounds of
- Promiscuity or other immoral conduct, sexual deviancy
- Cultural, religious or political beliefs
- Cultural, religious or political beliefs
- Commission, or likely commission, of illegal or disorderly acts
The crucial one is probably the last one.
Of course these are not barriers to the detention of someone with another reason for detention, simply that detention cannot be solely on these grounds. The exclusion of alcohol or drug dependency also remains.
