48: Clause 9, page 9, line 33, at end insert-“(5) Regulations made under this section that amend or replace primary legislation must be subject to the affirmative resolution procedure.(6) Before making any regulations under this section, the Secretary of State must-(a) conduct a consultation for a period of no less than six weeks;(b) publish a statement outlining the purpose and necessity of the proposed regulations, the expected impact on businesses, consumers, and enforcement bodies, and the outcome of the consultation.(7) Within six months of any regulations made under this section which amend or repeal primary legislation, the Secretary of State must publish a review of the effect of that regulation and lay it before Parliament.”Member’s explanatory statementThis amendment requires that any regulations made under Clause 9 that amend or replace primary legislation be subject to the affirmative resolution procedure.
