First-tier Tribunal (Immigration and Asylum Chamber) Fees Order 2011 — Fees for Appealing Immigration Decisions — 12 Oct 2011 at 19:20
The majority of MPs voted to introduce fees for appealing immigration decisions to the Immigration and Asylum Chamber of the First-tier Tribunal.
The majority of MPs approved the motion:
- That the draft First-tier Tribunal (Immigration and Asylum Chamber) Fees Order 2011, which was laid before this House on 12 July, be approved.
Fees charged under the order are subject to a number of exemptions contained within article 5 of the order, and include appeals against decisions to deprive an individual of their right of abode, or citizenship; decisions on various categories of removals, and decisions to revoke indefinite leave to enter or remain in the UK.
The explanatory notes to the order[1] state:
- The Government believes that it is appropriate that users of the Tribunal contribute towards the cost of their appeal where they can afford to do so.
and:
- this is the first instance of fees being imposed in an instance involving action by the state against individuals.
