Growth and Infrastructure Bill — Clause 5 — Central Government Funding to Fulfil Affordable Homes Requirement on Developments — 17 Dec 2012 at 18:45

The majority of MPs voted for those required to provide affordable housing as a requirement of planning permission for a development to be able to apply for the requirement to be met in full, or part, by central government funding allocated for the delivery of affordable homes.

MPs were considering the Growth and Infrastructure Bill^[1]. The amendment rejected in this vote was:

• Amendment 46, page 6, line 40, at end insert
• ‘or,
• (e) request that the requirement is to be met in part, or in full, by central government funding allocated for the delivery of affordable homes.’.

Had the amendment not been rejected it would have affected Clause 5^[2] of the Bill titled Modification or discharge of affordable housing requirements which provides for a new section for the Town and Country Planning Act 1990 starting:

• (1) This section applies in relation to an English planning obligation that contains an affordable housing requirement.
• (2) A person against whom the affordable housing requirement is enforceable may apply to the appropriate authority—
• (a) for the requirement to have effect subject to modifications,
• (b) for the requirement to be replaced with a different affordable housing requirement,
• (c) for the requirement to be removed from the planning obligation, or
• (d) in a case where the planning obligation consists solely of one or more affordable housing requirements, for the planning obligation to be discharged.
