Police, Crime, Sentencing and Courts Bill — New Clause 91 — Review of Criminal Offences in the Misuse of Drugs Act 1971 — 5 Jul 2021 at 18:30

The majority of MPs voted against a review of the criminal offences in the Misuse of Drugs Act 1971.

MPs were considering the Police, Crime, Sentencing and Courts Bill^[1][2]

The proposed new clause rejected by the majority of MPs in this vote was titled: Review of the Misuse of Drugs Act 1971 and stated:

• (1) The Secretary of State must conduct a review of the criminal offences in the Misuse of Drugs Act 1971.
• (2) In undertaking the review, the Secretary of State must consult—
• (a) the Advisory Council on the Misuse of Drugs;
• (b) the Scottish Ministers;
• (c) the Welsh Ministers;
• (d) the Northern Ireland Department of Health, and
• (e) any other person the Secretary of State considers appropriate.
• (3) The Secretary of State must, before the end of the period of 9 months beginning with the day on which this Act comes into force, lay before Parliament a report on the review, including any proposals for legislative change

The rejected new clause was accompanied by the following explanatory statement from its proposer:

• This new clause would require the Secretary of State to undertake a review of the criminal offences set out in the Misuse of Drugs Act 1971.
